Ed Holmes was Counsel for OPSEU. The Arbitrator determined that the Ministry through its management employees dealt with the Grievor “in a contumacious and continuous abrogation of its duty of care to the Grievor” in contravention of its duty of care to maintain civility in the workplace. The Employer was found to have “tolerated, condoned and participated in the promotion of incivility” against the Grievor.
