Christopher Bryden successfully convinced the Divisional Court to overturn a Grievance Settlement Board (GSB) decision in which that GSB held that it had no jurisdiction to award monetary damages to an employee over his employer’s failure to promptly investigate his allegations that he had suffered a racially-motivated physical and verbal assault at the hands of a coworker outside of the workplace.  The Court agreed that the GSB’s decision was patently unreasonable and remitted the issue back to the GSB, where Chris successfully convinced the same Arbitrator that the GSB did in fact have jurisdiction to award monetary damages to the employee for the employer’s failure to investigate the matter in a timely and proper manner.
